The Saga Continues

The ENGO's arguments all got tossed but they vow to take it to the supreme court.

All the First Nations challenges are going to court but all are basically the government did not consult with us enough.

"Six were based solely on the potential negative environmental impacts of the pipeline, and those challenges were dismissed because there were re-litigating previous court cases. The other six were brought by affected First Nations groups and focused on whether Ottawa had fulfilled its duty to consult."


Remember that "Ottawa appointed a former judge to oversee consultations with First Nations over Trans Mountain expansion." So it will be interesting if anything is made of it in court you would think that a former judge would be capable of handling consultations.

What is odd in all this is the federal government apparently presented no evidence of consultation and that forced the judge to hear these cases. How does a former judge not have any evidence to present?? Will be pretty funny tho if they find the judge did not consult properly.

"In a move that has frustrated the oil industry and confused some legal experts, the federal government chose not to provide evidence prior to this decision on how it carried out its legal duty to consult with affected Indigenous communities along the pipeline route — so Stratas said he had to grant leave for the appeals."
